1. Introduction

Welcome to The Fin Library. By using our website at www.thefinlibrary.com or renting products from us, you agree to these terms and conditions. These terms apply to all customers and may be updated from time to time. Continued use of our service means you accept any changes.

Age Requirement: You must be 18 or older to rent from us. If you're under 18, a parent or guardian must place the order on your behalf.

2. Definitions

Normal Wear and Tear: Light scratches, scuffs, or minor cosmetic marks that don't affect the fin's performance or structural integrity.

Excessive Damage: Broken fins, deep gouges, cracks, missing pieces, bent or warped fins, or damage requiring professional repair that makes the fin unsuitable for future rental.

Rental Period: The time from when we ship your order until the return deadline shown in your order confirmation.

3. How Rentals Work

3.1 Ordering: Choose your fin and rental period (1, 2, or 3 months). Complete checkout with your shipping details and payment.

3.2 Payment: We charge the rental fee plus a refundable deposit upfront. All prices are shown on the product page before checkout.

3.3 Cancellation: You can cancel your order within 2 hours of placing it for a full refund. After we ship your order, cancellations aren't possible, but you can return the fin early (rental fees are non-refundable).

3.4 What's Included: Your rental includes the fin, outbound shipping, return packaging, and return shipping label.

4. Your Responsibilities

  • Inspect the fin when it arrives and report any damage within 48 hours
  • Use the fin responsibly and report any damage immediately
  • Return the fin by the deadline in your order confirmation
  • Use the provided return packaging and shipping label
  • Keep the fin in good condition (normal wear and tear is expected)

5. Returns and Deposits

5.1 Return Condition: We'll refund your full deposit when you return the fin in acceptable condition. Normal wear and tear is fine.

5.2 Damage Charges: If there's excessive damage, we'll deduct repair or replacement costs from your deposit. We'll email you photos and an explanation of any charges.

5.3 Late Returns: Returns received more than 7 days after the deadline incur a €10 per day late fee, deducted from your deposit.

5.4 Lost Returns: Once the return package gets its first postal scan, we're responsible if it's lost. Without a scan, you're responsible for the full replacement cost.

6. Shipping and Delivery

6.1 Delivery: We aim to ship within 1-2 business days. Delivery times vary by location but typically take 3-7 days within Europe.

6.2 Failed Delivery: If delivery fails due to wrong address information you provided, redelivery costs will be charged to your deposit.

6.3 Lost Shipments: If your order is lost during delivery to you, we'll send a replacement or provide a full refund.

7. What We Don't Cover

7.1 Liability Limit: Our total liability to you is limited to the amount you paid for your rental. We're not responsible for any indirect damages or losses.

7.2 Use at Your Own Risk: Surfing involves inherent risks. We're not liable for injuries or accidents while using our fins.

7.3 Product Defects: While we inspect all fins, we can't guarantee they're defect-free. By using a fin, you accept its condition.

8. When Things Go Wrong

8.1 Contact Us First: If you have any issues, please contact us at info@thefinlibrary.com. We'll work to resolve problems quickly and fairly.

8.2 Force Majeure: We're not responsible for delays or failures due to circumstances beyond our control (natural disasters, strikes, pandemics, etc.).

9. Account Suspension

We may suspend accounts for non-payment, repeated damage to rental items, or violation of these terms. Suspended accounts cannot place new orders.

10. Changes to Terms

We may update these terms occasionally. We'll post changes here and notify active customers by email. Continued use of our service means you accept the updated terms.

11. Governing Law

These terms are governed by Irish law. Any disputes will be resolved in Irish courts, though we'd prefer to work things out directly with you first.
